Aug 05, 2024
New Delhi [India], August 5 : The Delhi High Court recently asked a farmers' body to place on record the details of attacks on farmers during the 2020 farmers protest.
Farmers body has moved a petition seeking institution of SIT for alleged attacks on farmers during protest.
Petitioner Kisan Mazdoor Sangharsh Committee has sought a direction for institution of court monitored SIT to carry out an investigation into the attack which was done on the farmers, during the agitation against the farming legislations in 2020, at the borders of Delhi.
Justice Anish Dayal is dealing with the petition filed in 2021.
During the hearing, Additional Standing counsel (ASC) stated that the threshold for instituting an SIT is high as established by the Supreme Court, as also they have a right to file application under Section 156(3) CrPC before the competent Court.
Advocate Ajay Verma counsel for petitione Committee sought some time to address arguments in this relation. Justice Dayal granted time to counsel.
"He shall file short written submissions synopsizing the various incidences and the evidence that he has placed on record, with court file page numbers, on the basis of which he prays for an SIT, and the relevant law to counter the learned ASC's contentions," Justice Dayal directed on August 1.
It was stated by avocate Ajay Verma that while certain FIRs were registered against the protestors, the attacks by various miscreants on the protestors were not taken into account, and despite their repeated representations, no action has been taken and no investigation has been done.
Petitioner committee has alleged that State's view is not independent in its basis, considering that there was complexity of various police officials in this situation.
Delhi police have already filed a status report in the matter.
The bench has listed the matter for hearing on November 28.
