FSL report awaited since 2019, Delhi court calls for action against Investigation Officer

New Delhi [India], August 28 : A Delhi Court is waiting for Forensic Science Laboratory (FSL) report for last five years in a case of obstructing public way. Now the court has recommended Departmental action against the Investigation Officer (IO).
The court has also issued notice to the Director Forensic Science Laboratory (FSL) to expedite the inquiry and file the result.
This case pertains to an FIR registered at Police Station Dadar Bazar in 2019. It is at the stage of arguments on charge.
A reply has also been sought from the Joint Commissioner of Police under his personal signature.
Judicial Magistrate (First Class) said, "This court is of considered opinion that IO/SI Parveen Kumar has deliberately failed to take steps despite repeated reminders of this court."
"Accordingly, this court recommends that departmental action be initiated against IO/SI Parveen Kumar for failing to get the FSL examination conducted," Judicial Magistrate Gaurav Goyal said in the order passed on August 24.
The court also directed that a copy of this order be sent to the Joint Commissioner of Police, Central Range for filing of reply on the next date of hearing (NDOH).
"Let copy of this order be also sent along with the notice to the worthy Joint Commissioner of Police, Central Range," the court directed.
The court also said that it is impressed upon the Joint Commissioner of Police that the reply be forwarded to this court under his personal signature only.
The court has issued a fresh notice to the IO who was absent during the hearing.
"Let fresh notice be issued to IO/SI Vikash Rathi, SHO PS Sadar Bazar and ACP Sadar Bazar to appear before this court in person at 10.00 AM on the NDOH," the court ordered.
The court said that no exemption shall be entertained by this court from IO, SHO Sadar Bazar and ACP Sadar Bazar on the NDOH.
The court noted on August 24, "Today again, SHO PS Sadar Bazar is absent despite service. Today again, adjournment is sought by Inspector Sanjay Kumar for filing of FSL result as the FSL result is still not ready."
On the last date of the hearing (LDOH), reply was also received from DCP North stating that request has already been sent to Director, FSL to expedite the inquiry and file the FSL report on the NDOH.
The court has also issued notice to Director, FSL to expedite the inquiry and file the FSL result before this court on the NDOH.
The court has listed the matter for hearing in September last week.
