North East Delhi violence: Court acquits two accused of rioting and arson, giving benefit of doubt

New Delhi [India], December 27 : A Delhi Court has recently acquitted two men accused of rioting and setting two bikes on fire during North East Delhi violence in February 2020 in the Dayal Pur area.
The court acquitted the accused persons, giving them the benefit of the doubt. The court held that the accused can not be held guilty based on evidence placed before the court.
This pertains to an FIR registered at police station Dayal. This case was registered on the complaint of one Surendra Kumar Bansal.
Additional Sessions Judge (ASJ) Pulastya Pramachala of Karkardooma Court acquitted accused Firoz Khan, alias Pappu and Mohd. Anwar in a case registered under sections related to rioting and destruction of property by fire.
ASJ Pramachala said, "I find that charges levelled against the accused persons in this case are not proved beyond reasonable doubt. Hence, accused Firoj Khan, alias Pappu and Mohd. Anwar are acquitted of all the charges levelled against them in this case."
The Court observed, "Thus, the evidence produced by the prosecution shows that a riotous incident took place on February 24, 2020, but there is no evidence to show that either of the accused persons was part of the responsible mob."
"In that situation, both the accused herein cannot be held responsible for the incident probed in this case," the court said in the judgement passed on December 19, 2023.
In his complaint, the complainant alleged that on February 24, 2020, rioters vandalised and looted his shutter parts shop under the name and style of "Shree Balaji Rolling Shutters." That shop was situated in Mahalaxmi Enclave, Brijpuri Road, Karawal Nagar.
The complainant further alleged that in that incident, his two motorcycles were also set on fire. The complainant further alleged that he suffered losses of approximately Rs 5-6 lakh.
After investigation, the accused were charged by the police for having committed offences punishable under Section 147/148/149/427/436 IPC.
